Terms of Service

1. Service Provider Identification

The provider of BeRelevant services (hereinafter \"Service\" or \"Platform\") is:

These Terms of Service govern the relationship between the Provider and the User in accordance with Act No. 22/2004 Coll. on Electronic Commerce, Act No. 108/2024 Coll. on Consumer Protection and on Amendments to Certain Acts, and other applicable laws of the Slovak Republic.

2. Definitions

For the purposes of these Terms of Service:

Provider

Provider – the legal entity specified in Article 1 of these terms

User

User – a natural or legal person who uses the Service

Consumer

Consumer – a natural person who enters into and performs a contract outside the scope of their business activity, employment or profession

Entrepreneur

Entrepreneur – a natural or legal person who independently carries out a gainful activity under their own name and at their own risk

Service

Service – BeRelevant cloud SaaS platform designed to monitor and optimize brand visibility in AI search engines

Account

Account – personal user account created in the Service after registration

Subscription

Subscription – paid service with recurring billing according to the selected pricing plan

Brand

Brand – website, domain or business added by the user to the platform for monitoring

AI search engine

AI Search Engine – artificial intelligence providing search services (ChatGPT, Perplexity, Claude, Google AI Overviews, Gemini)

3. Subject of Contract and Service Description

The Provider grants the User access to the BeRelevant cloud SaaS platform, which enables:

• Monitoring brand visibility in AI search engines (ChatGPT, Perplexity, Claude, Google AI Overviews, Gemini)
• Tracking brand mentions, citations and sentiment in AI responses
• Analysis and evaluation of the GEO (Generative Engine Optimization) factor of websites
• Competitor comparison (Share of Voice)
• Providing recommendations to improve AI visibility
• Generating reports and analytical overviews
• Alerts about changes in AI visibility

The Service is provided through a web interface at https://berelevant.now. The Provider makes reasonable efforts to keep the Service available without interruption but does not guarantee continuous availability. The current operational status is published at https://berelevant.now/status.

The range of features depends on the selected pricing plan. The Provider reserves the right to update, modify or add Service features without prior notice, provided this does not limit the basic scope of services ordered by the User.

4. Registration and Account Creation

Registration process

1. Registration is voluntary and free
2. During registration, the User provides an email and creates a password
3. User must confirm agreement with Terms of Service and Privacy Policy (separate checkboxes)
4. Consent to receive marketing emails is optional
5. After registration, the User receives a confirmation email
6. The account is active immediately after email address confirmation

User obligations

The User is obliged to provide truthful, accurate and current information. The User is responsible for:

• Maintaining confidentiality of login credentials (email and password)
• All activities performed under their account
• Immediately reporting any unauthorized use of the account to: admin@berelevant.now
• Complying with these Terms of Service and applicable laws

Prohibited activities

The User must not:

• Share login account with third parties
• Abuse the Service for illegal or unethical purposes
• Attempt to hack, reverse engineer or breach Service security
• Automatically extract data from the Service (scraping, crawling) without written consent
• Use the Service to send spam or unauthorized marketing messages
• Create a competing service based on BeRelevant functionality

The Provider reserves the right to immediately terminate the User's account in case of violation of these terms, without entitlement to refund of fees.

5. Pricing Plans and Payment Terms

Available pricing plans

The Service is available in the following pricing plans:

The current price list is available at https://berelevant.now/pricing. The provider is not a VAT payer, so the prices shown are final and no VAT is added.

Payment terms

• Subscription is billed monthly or annually in advance (according to User selection)
• Payments are processed through the Stripe payment gateway
• Accepted payment methods: Credit card (Visa, Mastercard), SEPA bank transfer (annual plans only)
• Subscription automatically renews every month/year unless cancelled by the User
• Once a payment is received, the invoice is available in the Billing section of your account
• The Provider is not a VAT payer. Invoices are issued without VAT in accordance with applicable Slovak law.
• All payments are in EUR (€)

Free plan

• The Service can be tried on the Free plan, which is not time-limited
• No payment details are required to register or to use the free plan
• Moving to a paid plan is voluntary and the User can cancel it at any time
• The scope of the free plan is set out in the pricing page at https://berelevant.now/pricing

Price changes

• The Provider reserves the right to change prices with 30 days prior notice
• Price changes do not apply to existing active subscriptions until renewal
• Users will be notified by email and banner in the application

6. Right of Withdrawal (Consumers)

In accordance with Act No. 108/2024 Coll., a consumer (a natural person not acting within their business activity) has the right to withdraw from the contract without giving a reason within 14 days of concluding the contract. For service contracts, the period runs from the conclusion of the contract; if the consumer expressly requests that performance begin before the period expires, a proportional charge for the service already provided may apply.

Refund

• The Provider will refund all payments received from the consumer within 14 days of receipt of the withdrawal notice
• The refund will be made using the same payment method by which the payment was received (unless the consumer expressly agrees to a different method)
• The consumer will not incur any additional fees for the refund
• If the consumer expressly requested that the Service begin before the period expired and was properly informed, the Provider is entitled to proportional payment for the service already provided

Exceptions to the right of withdrawal

The right of withdrawal does not apply to:

• Services that have been fully provided before the 14-day period expired with the consumer's prior express consent and acknowledgment that they lose the right of withdrawal once the service has been fully provided
• Digital content delivered via the internet if the consumer gave prior express consent for its provision and acknowledged that they lose the right of withdrawal once delivery is completed

Entrepreneurs: The right to withdraw from the contract within 14 days does not apply to entrepreneurs (legal entities or natural persons acting within their business activity). For entrepreneurs, the provisions on subscription cancellation set out in Article 7 of these terms apply.

7. Subscription Cancellation

Cancellation by user

• User can cancel subscription at any time through account settings in the application or by email to: admin@berelevant.now
• Cancellation takes effect at the end of the current paid period
• User has access to paid features until the end of the paid period
• Cancellation during the paid period does not result in proportional refund (applies only to entrepreneurs, consumers have the right to withdraw under Article 6)
• After a subscription is cancelled, data are retained for as long as the user account exists. After the account is closed they are deleted without undue delay, except for data needed to comply with legal obligations and to establish and defend legal claims

Service suspension by provider

The Provider may suspend access to the Service in the following cases:

• Non-payment of invoice within 7 days after due date
• Violation of Terms of Service or legal regulations
• Service abuse or suspicion of fraudulent activity
• Planned maintenance (with at least 48 hours prior notice)

The Provider will inform the User of the suspension by email

After removal of the suspension reason, the Service can be restored

Contract termination by provider

• The Provider may immediately terminate the contract in case of serious breach of terms by the User
• For other termination reasons, a 30-day notice period must be observed
• In case of termination for reasons on the Provider's side (except breach of terms by the User), a proportional part of the subscription will be refunded

8. Intellectual Property Rights

Platform ownership

All content, design, features, source code, databases, graphics, logo and other elements of the BeRelevant platform are the exclusive property of the Provider or its licensors.

The platform is protected by copyright (Act No. 185/2015 Coll.), trademarks and other intellectual property rights of the Slovak Republic and international agreements.

License to use

The Provider grants the User a non-exclusive, non-transferable, time-limited (for the duration of the subscription) license to use the Service in accordance with these Terms of Service

The User must not:

• Copy, reproduce, modify or create derivative works from the platform
• Distribute, sell, lease, license or otherwise make the platform available to third parties
• Perform reverse engineering, decompile or disassemble the platform
• Remove, alter or obscure copyright, trademark or other rights notices
• Use the platform to create a competing product or service

User data ownership

The User remains the owner of all data they input into the platform (brand names, domains, settings, notes)

The Provider has the right to use aggregated and anonymized data for Service improvement, analytics and marketing purposes (without identifying specific users)

The User may request an export of their data by e-mail at admin@berelevant.now; the export is provided in a machine-readable format (JSON) within the period set by Art. 20 GDPR

Trademarks

"BeRelevant", the BeRelevant logo and other marks used in connection with the Service are registered or unregistered trademarks of the Provider

Use of these trademarks without written consent of the Provider is prohibited

9. Personal Data Protection (GDPR)

The Provider processes User personal data in accordance with GDPR (EU Regulation 2016/679) and Act No. 18/2018 Coll. on Personal Data Protection.

10. Limitation of Liability

Service "as is"

The Service is provided "as is" (AS-IS) and "as available" (AS-AVAILABLE). The Provider does not provide any warranties, express or implied, regarding:

• Accuracy, reliability or completeness of data obtained from AI search engines
• Continuous Service availability without interruptions or errors
• Specific results or improvement in AI visibility when using the Service
• Compatibility with specific devices, browsers or software

Limitation of damages

To the maximum extent permitted by Slovak law, the Provider is not liable for:

• Indirect, incidental, consequential or special damages
• Loss of profit, revenue, data or business opportunities
• Damages caused by Service outage or unavailability
• Damages caused by third parties (AI platforms, payment gateways, hosting providers)
• Damages caused by improper use of the Service or breach of these terms

The maximum amount of damages is limited to the amount corresponding to the subscription price for the last 12 months, but not more than €1,000

Exceptions to limitation of liability

The limitation of liability does not apply to:

• Damages caused by intentional conduct or gross negligence of the Provider
• Health damages or damages to life
• Consumer rights arising from mandatory provisions of Act No. 108/2024 Coll. on Consumer Protection
• Obligations arising from GDPR and Personal Data Protection Act

Force majeure

The Provider is not liable for non-performance or delay caused by force majeure events, including but not limited to: natural disasters, wars, terrorist attacks, pandemics, power outages, internet outages, cyber attacks, government bans, legislative changes or restrictions by AI platforms (ChatGPT, Perplexity, Claude, Google)

11. Dispute Resolution and Complaints

Complaint procedure

If the User is not satisfied with the Service or has objections, they can file a complaint:

• By email to: admin@berelevant.now
• Complaint form: https://berelevant.now/complaint
• By mail to the company's registered office (Art. 1)

The complaint must include: User's name and email, problem description, date of occurrence, requested solution

The Provider commits to handle the complaint within 30 days of receipt

The response to the complaint will be sent by email or mail (according to User's choice)

Out-of-court dispute resolution (ADR)

Consumers can contact the Slovak Trade Inspection (SOI) as the out-of-court consumer dispute resolution body. Current EU-wide dispute guidance is available on Consumer Redress in the EU.

Judicial dispute resolution

• Courts of the Slovak Republic
• For consumers, the provision of § 14 of the Code of Civil Procedure applies – court according to the consumer's residence
• For entrepreneurs, the court according to the Provider's registered office is competent
• Relations not regulated by these Terms of Service are governed by the legal order of the Slovak Republic

12. Changes to Terms of Service

The Provider reserves the right to change or supplement these Terms of Service at any time

Method of notification of changes

The Provider will inform Users about changes to the Terms of Service:

• By email (at least 30 days before effectiveness)
• By notification in the application after login
• By publishing the new version at https://berelevant.now/terms

Acceptance of changes

For minor changes (without impact on User rights), we will publish a notice and the updated version will apply from the stated effective date

For substantial changes (e.g., price change, scope of services, liability), the User may within 14 days of notification:

• Accept new terms (by continuing to use the Service)
• Reject new terms and cancel subscription without fee (with the right to proportional refund for unused period)
